The family of a 13-year-old who was fatally shot by a Sonoma County sheriff's deputy will receive $3 million in a settlement announced on Tuesday.

The Sonoma County Board of Supervisors said they'd settled the excessive force lawsuit with the family of Andy Lopez, who was killed in 2013.

As part of the deal, Sonoma County did not admit it was liable for Lopez's killing on Oct. 22, 2013.

Then-Deputy Erick Gelhaus, who's since risen to sergeant, shot Lopez seven times as the teen walked along Moorland Avenue with a pellet gun near Santa Rosa.

The gun was designed to resemble an AK-47.

Gelhaus said he believed it was a real assault rifle and that the barrel raised upward when Lopez turned to face him.
