Civil Rights Attorney Files Lawsuit Against Walnut Creek Police

A civil rights attorney is filing a federal lawsuit against the city of Walnut Creek and five police officers involved in the killing of a young man in the midst of a mental health crisis this summer. 

Attorney John Burris filed the lawsuit after Miles Hall, 23, was shot and killed by Walnut Creek Police. Hall had reportedly been in the middle of a psychiatric episode at the time of the shooting in June. Police had been warned about his mental state by Hall's family.

"Police arrived on the scene. [Hall> is running by these officers, and he began to run by them," Burris said. "He's a good 20 yards away from them, and as he goes by, he pivots to the right and they shoot and kill him. It's shocking."

Burris said that he believes this case warrants criminal prosecution.

"These officers took aim at this young man as he was running by," Burris said. "They were not in danger. And they took the life of a 22-year-old young man, so there are consequences to that."

The incident was captured on police body cameras.

The Walnut Creek Police Department has not returned requests for comment.
