Suspect Charged With Murdering Oakland Councilwoman's Son

A suspected gang member has been charged with killing the son of an Oakland city councilwoman in Los Angeles in March.

The Los Angeles County District Attorney's Office announced 23-year-old Ivan Hernandez was charged Tuesday with one count of murder during an attempted robbery and murder while being an active participant in a criminal street gang. His arraignment is pending. 

Hernandez allegedly shot 21-year old Victor McElhaney, the son of Councilwoman Lynette Gibson McElhaney, in March about a mile from the USC campus.. McElhaney, a passionate drummer, was studying music at USC.

If convicted, Hernandez could face life in prison without possibility of parole or the death penalty.

Prosecutors will decide later whether to seek capital punishment, although Gov. Gavin Newsom has issued a moratorium on executions in the state.
